Plain-language summary: No payment is needed to get started. We build a basic version of your homepage first, show it to you, and once you approve it, a 50% advance is due before we continue with the rest of the site. The remaining 50% is due before launch. Our 10-working-day build estimate starts once we have everything we need from you, including a working domain, hosting, and any payment gateway or bank account setup, not from the date you first contact us. If we're busy with other jobs, we'll tell you before accepting yours if that timeline can't be met.

Who these terms apply to

These Terms and Conditions ("Terms") govern any website design, development, ecommerce, domain and hosting assistance, or maintenance service (a "Project") provided by MS Lifestyle Trading CC, trading as Trelio Digital ("Trelio Digital", "we", "us", "our"), to any person or entity that engages us for a Project ("you", "the client").

By approving a quote, paying an advance, or instructing us to begin work in any form (including email or WhatsApp confirmation), you agree to be bound by these Terms.

We work with registered businesses, sole proprietors, non-profits, event organisers, and individuals commissioning personal or once-off sites (such as weddings or portfolios). Where these Terms refer to "your business" or similar, the same clause applies equally to non-business clients unless the context makes that impossible.

02 · Our services

Our services

Trelio Digital provides:

  • Website Development: custom-built websites, built on WordPress with Elementor unless otherwise agreed.
  • Ecommerce Development: online stores including product catalogues, checkout, and payment gateway integration.
  • Domain & Hosting Assistance: guidance on choosing and setting up a domain name and hosting account, provided free of charge as part of a build.
  • Website Maintenance: ongoing security updates, plugin updates, and minor content edits under a Care Plan (see clause 11).

The exact scope, pages, features, and price for a Project are set out in a written quote or proposal sent to you before work begins. That quote, together with these Terms, forms the full agreement for the Project.

03 · How a project runs

How a project runs

Projects follow this general process:

  1. Kickoff: we discuss your goals, audience, and what the site needs to achieve. No payment is required at this stage.
  2. Homepage creation: we build a basic version of your homepage first, as a preview of the direction, look, and feel of the full site. No payment is required for this step.
  3. Approval and advance: once we've shown you the basic version of your homepage and you approve its direction, a 50% advance becomes payable before we continue building the remaining pages (see clause 4).
  4. Full build: we build out the rest of the agreed pages, forms, and functionality.
  5. Domain & launch: once the remaining balance is paid in full, we assist with domain and hosting setup (or connect to your existing setup) and launch the site.
  6. Ongoing care (optional): if you take a Care Plan, we continue providing security updates, backups, and minor edits.
04 · Payment terms

Payment terms

No advance payment is required to start a Project. We create a basic version of your homepage first, at our own initial cost, so you can see real work before committing any money.

A 50% advance becomes due once we've built a basic version of your homepage, shown it to you, and you've approved the direction. This advance must be paid before we begin building the remaining pages and functionality.

The remaining 50% balance is due before the completed website is launched, handed over, or connected to a live domain. We do not publish, transfer, or hand over a site before the balance is settled in full.

Invoices are issued in South African Rand (ZAR). Accepted payment methods and banking details are provided on each invoice. Unless otherwise agreed in writing, quoted prices exclude any third-party costs such as domain registration fees, hosting fees, premium plugins or themes, stock imagery licences, or payment gateway transaction fees, which are billed separately or paid directly by you to the relevant provider.

05 · Turnaround time

Turnaround time

Where we quote a standard turnaround time of 10 working days, that estimate begins only once all of the following are in place:

  • You have provided all content, information, and material we need (text, images, logos, product details, and any other content required for the site).
  • Domain and hosting are set up and accessible to us, whether through our assistance or your own existing accounts.
  • Any bank account and/or payment gateway required for the Project (for example, for ecommerce sites) has been set up and fully verified by the relevant provider.

Payment gateway and merchant account verification is carried out by third-party providers (such as PayFast, Yoco, PayGate, or your bank) and is entirely outside our control. This process can reasonably take up to two weeks, and sometimes longer, depending on the provider and the completeness of your submitted documents. Time spent waiting on this verification does not count toward, and does not begin, the 10-working-day turnaround estimate.

During busier periods, we may not be able to start or deliver your Project within the standard 10-working-day estimate. Where this is the case, we will tell you upfront, before we accept your order or job, so you know the realistic timeline before committing.

Delays caused by late content, slow feedback, or outstanding client-side tasks will extend the turnaround time accordingly, and are not treated as a delay on our part.

06 · Client responsibilities

To keep your Project on track, you agree to:

  • Provide accurate, complete content and information in a reasonably timely manner.
  • Respond to requests for feedback, approval, or missing information within a reasonable time.
  • Ensure you have the legal right to use any content, images, logos, or trademarks you provide to us for use on your site.
  • Complete any required third-party setup (such as a business bank account or payment gateway application) as early as possible, given the verification times described in clause 5.

We are not responsible for delays or additional costs arising from incomplete, inaccurate, or late information or materials provided by you.

07 · Revisions and scope

Revisions and scope

Reasonable, good-faith revisions within the agreed scope of your quote are included in your quoted price, at no additional per-revision charge. You will see and approve the basic version of the homepage design before we build out the rest of the site, giving you an early opportunity to request changes.

Requests that fall outside the original agreed scope, such as additional pages, new features, or a substantial change in direction after work has begun, may require a separate quote and additional time before we proceed.

08 · Cancellations and refunds

Cancellations and refunds

Before the advance is invoiced (i.e. during kickoff or creation of the basic homepage version), you may cancel at any time at no cost, since no payment has been made and no advance invoiced at that stage.

Once the 50% advance has been paid, it becomes non-refundable. The advance covers the time, design work, and resources already committed to your Project at that point, and its purpose is to secure your place in our schedule and confirm the build going forward.

If a Project is cancelled after the advance is paid but before the balance is due, no further payment is owed by you beyond the advance, and we retain ownership of all work produced (see clause 9) until the Project is either completed and paid in full, or formally terminated by mutual agreement.

If you cancel after the final balance has been paid and the site has been launched, no refund is due, as the Project has been completed and delivered in accordance with the agreed scope.

09 · Ownership and intellectual property

Ownership and intellectual property

Until your Project is paid in full, all designs, code, and materials produced by Trelio Digital remain our property, and may not be copied, published, or used by you or any third party.

Once your Project has been paid in full, ownership of the final website, its design, and its content (excluding any third-party licensed assets such as stock photography, premium plugins, or fonts with their own licence terms) transfers to you. There is no lock-in: you are free to move your site to another host or developer at that point.

You retain ownership of any content, images, logos, or trademarks you provided to us. By providing them, you confirm you have the right to do so, and you grant us permission to use them solely for the purpose of completing your Project.

We reserve the right to display completed, launched Projects in our own portfolio and marketing materials, unless you request otherwise in writing.

10 · Domain, hosting and third-party tools

Domain, hosting and third-party tools

Where we assist with choosing and setting up your domain and hosting, we will explain the options and recommend a provider, but the domain and hosting account should be registered in your name and under your control, unless we agree otherwise in writing. We are not responsible for the ongoing policies, pricing, uptime, or support of third-party domain registrars, hosting providers, or payment gateways.

Where you already have a domain or hosting account, we will work with your existing setup where reasonably possible. If your existing setup is not suitable for the Project, we will tell you honestly and recommend alternatives.

11 · Care Plans (maintenance)

Care Plans (maintenance)

A Care Plan is an optional, month-to-month service covering security updates, backups, plugin updates, and small content edits, as described in your quote. A Care Plan is not required to own or use your website.

Care Plan fees are billed monthly in advance. Either party may cancel a Care Plan by giving 7 days' written notice. Cancelling a Care Plan does not affect your ownership of the website, but you will no longer receive the maintenance services covered by the plan.

12 · Warranties and liability

Warranties and liability

We aim to deliver a website that is fast, mobile-friendly, and functions as agreed in your quote. We do not guarantee specific business outcomes, such as a particular volume of enquiries, sales, bookings, or search engine rankings, since these depend on many factors outside our control.

To the maximum extent permitted by law, Trelio Digital's total liability for any claim arising from a Project is limited to the amount actually paid by you for that Project. We are not liable for indirect, incidental, or consequential loss, including loss of profit, business, or data, except where such exclusion is not permitted by South African law.

Nothing in these Terms limits any liability that cannot lawfully be excluded, including liability for gross negligence or under the Consumer Protection Act, where applicable.

13 · Indemnity

Indemnity

You agree to indemnify Trelio Digital against any claim, loss, or damage arising from content, images, logos, or trademarks you provided for use on your site, where you did not have the right to use or provide that material.

14 · Confidentiality

Confidentiality

Any business or personal information shared with us in the course of a Project will be treated as confidential and used only for the purposes of completing that Project, in line with our Privacy Policy.

15 · Force majeure

Force majeure

Neither party is liable for delay or failure to perform obligations under these Terms caused by circumstances reasonably beyond their control, including load shedding, internet or network outages, illness, or third-party service failures (such as hosting, domain registrar, or payment gateway outages). Affected timelines will be extended by a reasonable period once normal operations resume.

16 · Consumer Protection Act

Consumer Protection Act

Where you are a "consumer" as defined under the Consumer Protection Act 68 of 2008 ("CPA"), nothing in these Terms is intended to limit any right you have under the CPA. Where any part of these Terms conflicts with a right you have under the CPA, the CPA takes precedence to the extent required by law.

17 · Governing law and disputes

Governing law and disputes

These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from a Project will first be raised directly with us so we can try to resolve it informally. If it cannot be resolved this way, either party may refer the matter to mediation or to the courts of South Africa having jurisdiction.

18 · Changes to these terms

Changes to these terms

We may update these Terms from time to time to reflect changes in how we work or in the law. The version in effect at the time you engage us for a Project is the version that applies to that Project. Material changes affecting an active Project will be communicated to you directly.
